HAPPY VALENTINE'S DAY!I am a 45 year old attorney and criminal justice professor. I am married to an attorney/professor and I have six children; the oldest is 23 and the youngest is 9 months. My two oldest children are married, and my first grandchildren ( gulp!) will be coming this July from BOTH of them (due within 2 weeks of each other)! I live in the metropolis of Kaysville, Utah (just outside of Salt Lake City) and love the boring small town life. And, given all that, at heart I am still just a fanboy who cannot wait until the comics are put out on Wednesdays!I have been reading comics since my youngest memory, and I have been collecting comics since Daredevil #72 (first Marvel series, back in the early 70's). Although, it could have been since Superboy & The Legion of Super-Heroes #197, I am not sure. Anyhow, a while. Currently, I collect mainly DC comics, but I also follow stuff by great creators, including Ennis, Ellis, Morrison, Brubaker Starlin and, more than likely, YOU! The two constants in my collection has been the Legion of Super-Heroes (which is STILL the best title out there) and my good friend Batman (who scared away the monster under my bed). Thankfully, my Soul Mate (Clella) was open to reading comics with me while dating, especially after I read a SANDMAN comic to her about the dreams of cats. She has not found a lot of comics that catch her interest, but thankfully she puts up with me and helps feed the cats. Let me not forget the incredible amount of talent in the SMALL PRESS world, which in my small legalistic mind includes the incredible web comics. Things are really rocking all over. With the high quality of stuff coming out in comics everywhere, it is a great time to be a fan, and this community is a wonderful addition! Added January 2, 2007I should also note that I am a member of http://comicbloc.com, under my oh so dull real name, with the hopes that I will appear (or at least my name will appear) in a comic by Geoff Johns. I am a big fan of his, since his beginning days of writing JSA. Now, just point me in the direction of any comic written by him, and I tend to pull money out of my pocket. Added February 5, 2007A month has gone by, and my baby daughter is now 10 months old! I have been told that she is technically a "baby" until she is a year old, then 12-23 months she is a toddler, then 24 months up she is... um, I don't know, something else I guess. However, she will always be my beautiful baby! Her addition to our family has made every day brighter, and every holiday much more fun! This year, she is not incredibly active, but she did enjoy going down to Salt Lake City and looking at the Christmas lights at Temple Square, and I am sure each successive holiday with her will be more and more fun! I have already been reading her comics, and her favorite so far seems to be Justice Society of America. She allows me to get through about five pages before she desires to eat the comic, so I guess that is a plus! I also read Dr. Seuss books to her, so Geoff Johns is in very good company!

I have just spent some quality time on findlaw.com, nolo.com, and many other sites I found after Googling "intellectual property". Unfortunately, it seems that parody, in general, and satire, in particular, have become lawsuit targets in cases designed to shrink the definition of "fair use". It pretty much scared the pants off me. Still, I will continue investigating, because I don't feel like I've learned enough about it, yet. Remember a couple of years ago, the question of using Princess Di's likeness in X-Statics came up, and Marvel decided to go another direction. Often creators will change just enough of a character so that it is different, but you know who they are talking about. For instance, using an idiot blonde celebrity named London Marriott for Paris Hilton, etc. It is a crazy world! Now you see why I like criminal law... a LOT more fun! |

I'm nuts for kittens. Ooh! Ooh! And Batman! *starts singing the kitschy old Batman tv series theme* No, really. I love Batman. He's the best superhero of all, in my opinion, simply because he has no superpowers. He just has lots of cool toys and millions of bucks to play with. My kinda guy! ;P

All I was looking for here was a clue, and you were gracious enough to provide it. Personally, I have always loved the celebrity satire in Mad magazine. I was only six years old when I saw my first Mad, and that moment is forever burned into my brain. I have lots of special comics moments... of course, at this age, I have senior moments as well. Thankfully, I do not remember the senior moments. Good luck! I just looked at NOLO, and they have some great stuff on there. And, of course, GOOGLE has been my favorite research tool on the internet, and if you put "intellectual property" (in quotations, of course) into the search bar, you should get quite a few good articles.
I should note, my main area of expertise is criminal law, so if you have any criminal law questions, feel free to ask!

Would you know where I could find online information about the specifics of copyright law? What I need to know is this: if I draw Harry Potter or Madonna or any famous person, either real or imaginary, am I breaking the law if I post it on the web? So far, the only website I've found that addresses this at all is starvingartistslaw.com, and it's not really helpful for that issue. If that's outside your area of the law, I understand. Political cartoonists never seem to worry about that sort of thing, but the other intellectual property questions appear to form a gray area. If I'm wrong about this, please forgive me. I love to draw, but I'm not as informed as I'd like to be about the law. And I'm not putting you on the spot. I love the answer of "I don't know," as I use it a lot. However, I do know some of the fundamentals of copyright law (also known as "intellectual property", a phrase you may want to google). Use of a celebrity without their permission is prohibited. And one can see why; they are paid based upon their own efforts. The same is true with literary characters like Harry Potter; his creator is entited to all profits generated from his likeness. One can see that if you published a comic called THE FURTHER ADVENTURES OF HARRY POTTER, that it would be enormously popular, based on someone else's hard work, publicity efforts, etc. Now, this is true UNLESS the work being done is satire (humorous), which is allowed by the US Supreme Court. It is recognized that a person who has put themselves into the public spotlight has fewer protections as to their name as does a Shmoe like myself. Satire is protected (which is why the political cartoonists, The Daily Show, etc can use celebrities' names, likenesses, etc). One place to go to for research is www.findlaw.com, which has a LOT of information for free. You can also look at www.nolo.com, another place with lots of info plus inexpensive books. There should also be a law library nearby you if you want to do some good, old-fashioned research; I have found law librarians to be particularly nice and helpful!
